The hearing in this matter progressed to quite an extent. After considering the submissions of the learned advocate for the petitioner and on noticing the deficiencies, we expressed our disinclination.

The learned advocate for the petitioner, therefore, points out paragraph 9 from the affidavit in reply filed by Dr.Digambar Gaikwad dated 12.01.2021 vide which, the concerned Joint Director of Higher Education, Aurangabad has
*2* 928wp6227a6228o20 expressed a view that if the petitioner desires to seek permission for extension of syllabus/ subjects, namely, M.Sc. (Mathematics, Chemistry and Zoology), it can submit a fresh proposal as per the norms, for the next academic year 2021-2022 through a separate application. The learned AGP hastens to add that the process for consideration of the proposals for the academic year 2020-21 has been completed.

The learned advocate for the petitioner, therefore, submits that the petitioner is willing to move such proposal by following the due procedure, for academic year 2021-2022. 4.
In view of the above, both these Writ Petitions are disposed off with liberty as is prayed for.

Needless to state, if the proposal of the petitioner/ Management for the said three subjects is in order, the Government would act in accordance with law and take an appropriate decision.
