Applicant seeks to condone delay of 1785 days in preferring first appeal. It is submitted that both legs are amputated due to the injuries suffered in accident. He is facing various difficulties due to the disability. He has every hope in succeeding in appeal. 3.
Application is contested by the Respondent No.1. It is submitted that applicant is not entitled to interest and the statutory benefits for the delayed period. The application has been filed in a casual manner.

I have considered rival submissions of the parties. The averments of the application are not controverted by the respondents vsj..

Civil application is allowed and the delay stands condoned on condition that applicant shall not be entitled to interest and statutory benefits for the delayed period.
