PER COURT :- 1) It is informed by the counsel for the petitioner that since the petitioner could not comply with the condition in respect of deposit of the amount mandated by the DRAT, as a pre-condition for entertainment of the appeal, Respondent No.2 -MSC bank has initiated the steps for taking possession of the secured assets. The petitioner is still unable to make any statement as regards deposit of the amount. In this view of the matter, no interference is called for in the writ petition. The writ petition stands rejected.
