PER COURT:

Heard learned counsel for the petitioner, learned Govt. Pleader for the State and learned counsel for respondent No.9. At the outset, learned Govt. Pleader for State, on instructions, and relying upon the reply filed by the State, submits that already Departmental Enquiry is initiated against respondent No.9 and charge sheet is served. The Departmental enquiry will be taken to its logical end and appropriate decision will be taken, as expeditiously as possible and preferably within 3 months from today. In that view of the matter, the PIL stands disposed of.

We make it clear that we have not expressed any opinion on merits of the contentions made by the petitioner in PIL and those contentions are left open to be agitated at appropriate time. At this stage, learned counsel for the petitioner, on instructions of the petitioner, who is present in the Court Hall submits that an amount of Rs. 40,000/- may be refunded to the petitioner and remaining amount of Rs. 10,000/- may be given to the High Court Legal Services Sub Committee, Aurangabad.

{2} 934 sr.no..odt In the light of submission made by learned counsel for petitioner, Registry of this Court shall refund an amount of Rs. 40,000/- to the petitioner and remaining Rs. 10,000/- be transmitted to the High Court Legal Services Sub-Committee, Aurangabad.
