Upon pointing out that the appeal would not be tenable in this Court, but in the Sessions Court, Mr. P.B. Shirsath, learned counsel for the applicant/ appellant, on instructions, seeks withdrawal of the present application with liberty to file similar appeal before the Sessions Court.

Accordingly, the present criminal application is allowed to be withdrawn and stands disposed of as such.
