Heard learned counsel for the petitioner.

The petitioner assails the order dated 01.02.2021 passed below Exhibit 103 by learned Civil Judge, Junior Division, Parli Vaijnath, whereby, the application filed by the Defendant No. 4 under Section 10 of the Code of Civil Procedure for staying the proceedings in RCS No.139/2017 till disposal of the other suits relating to the property is rejected. 3.

Having gone through the order of learned Civil Judge, Junior Division, Parli Vaijnath, I find that the learned Trial Court has observed that parties in the instant suit are different from the previously instituted suit and the subject matter is also different. If the earlier suits are decreed and the decision therein would not affect the parties, therefore, I find no perversity in the order of learned Civil Judge, Junior Division, Parli Vaijnath. 4.

In view thereof, Petition is dismissed.
