In both these petitions, the same petitioner prays for either extension of the period for excavating the sand in view of the allotment of the 'Sand Ghat' or to refund the proportionate amount to the petitioner considering the circumstances in which he was prevented from excavating the sand.

Reliance is placed on the order dated 26/04/2022, delivered by this Court in, Writ Petition No.4578 of 2021 (M/s Pushpachandra Reti Contractor Vs. The State of Maharashtra and Another).

The Government Resolution (GR) dated 28/01/2022 issued by the State Government dealing with such situations, is placed before us. The learned Senior Counsel adds that the petitioner is an auction purchaser of a 'Sand Ghat.'

In view of the above, these petitions are disposed off. Considering the GR dated 28/01/2022, we direct the competent authority to deal with the two applications, both dated 06/06/2022, filed by the petitioner, by following the due procedure laid down in law, on or before 30/09/2022.
