(1) WP No.4587/2013
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD.
WRIT PETITION NO. 4587 OF 2013 Dr. Chandrakant Dattatraya Chavan.
Petitioner.
Versus
The State of Maharashtra and ors.
Respondents.
*** Mr. S.K. Chavan, Advocate holding for Mr. A.L. Tikle, Advocate for the petitioner.
Mr. M.M. Nerlikar, A.G.P. for respondent Nos.1 to 5. *** CORAM :
T.V. NALAWADE & SUNIL K. KOTWAL,JJ.
Dated :
25.01.2018.
ORDER :- 1.
The petition is filed for giving direction to the respondents to see that the name of the petitioner is included in the merit list of in-service Medical Officers for Admission to P.G. Degree/Diploma Courses-PG-2013 as per the marks secured by the petitioner in the National Eligibility-Entrance Test (Post Graduate) for admission to M.D./M.S. - 2013 Admission Session. Both the sides are heard.
2.
The submissions made show that the petitioner was inservice candidate. As per the procedure, he was expected to apply
(2) WP No.4587/2013 through proper channel i.e. through Department. But he directly sent his application for the Entrance Test by using on-line process. Learned Counsel submits that the letter was issued by the Authority on 21.05.2013 and the last date for submitting the application was 23.05.2013 and the petitioner had taken the steps on 22.05.2013 in that regard, but there was no sufficient time and so the application was submitted on-line.
3.
The record is produced to show that the petitioner had gone through the Test taken for giving admission to the Course. Due to interim order made by this Court dated 13.06.2013, the petitioner could complete the Course also. This Court continues the said relief. In view of this circumstance, this Court holds that nothing survives in this matter.
4.
The petition is disposed of. But this petition may not be treated as a precedent.
