Heard the learned counsel for the applicant, the learned APP for the respondent/State and the learned counsel for the informant.

The applicant seeks anticipatory bail in C.R.No.113 of 2024 registered with City Chowk Police Station, District Chhatrapati Sambhajinagar (Aurangabad) for the offences punishable under Sections 143, 323, 383, 436, 504, 506 of the Indian Penal Code.

The allegations against the applicants are that they set the shop of the complainant on fire, since he denied to pay them money. No weapon was allegedly used. Whatsoever the material was possible has been recovered. In the mean time, the parties have settled the dispute. The persons who suffered the loss have no grievance against the accused. Considering these two aspects, the custodial interrogation of the applicants may not be required. Hence, the order :-
ORDER
I) Application is allowed.
ii) In the event of arrest, applicants - (1) Md. Murtuza Khan s/o. Md. Yousuf Khan, (2) Unaiz Khan s/o. Md. Murtuza Khan,
(3) Md. Aman Khan s/o. Md. Musa Khan and (4) Musa Khan s/o. Yousuf Khan be released on bail, on executing PB and SB of Rs. 50,000/- with one solvent surety of like amount, in the above crime for the aforesaid offences, on the condition that they shall attend the trial on each and every date. iii) Criminal Application No.3002 of 2024 stands disposed of.
