Learned counsel Mr. Sonawane for appellants along with appellants, learned counsel Mr. Deshmukh for the respondent no. 3/Insurance Company, are present today. They tender on record the terms of settlement which is marked as exhibit 'X'. 3.
With the assistance of learned counsel, we have ascertained the identification of the claimants who are present. They confirm the terms of settlement exhibit 'X'.

It is informed that original claimant no. 5/Biharilal Tanha Gomladu and respondent no. 6/Smt. Punabai Biharilal Gomladu, are no more. They were dependents of the deceased. The claimants present today ,are the only dependents of the deceased. This aspect has already been clarified in the terms of settlement.

In view of the settlement, leave is granted to withdraw First Appeal No. 2231/2017.

In view of terms of settlement, out of the amount already deposited in First Appeal No. 2541/2017 Rs. 2,00,000/- shall be disbursed to the appellant/Insurance Company and the balance amount with accrued interest shall be disbursed to respondent nos. 1 to 4/claimants.

Both the First Appeals are disposed of.
8.
Court fees shall be refunded as per Rules.
9.
Award be drawn up accordingly.
10.
