In the present matter, the challenge is to the award under Section 140 of the Motors Vehicle Act. The learned Counsel submit that, this Court has dismissed an another appeal arising out of the same accident, bearing First Appeal No. 2699 of 2009. 2.

In light of the above, the present appeal is also disposed of. 3.

The amount deposited by the Insurance Company be transmitted to the Tribunal. The record and proceedings be sent back to the Tribunal forthwith. Considering the fact the claim petition is an old one, the Tribunal shall endeavour to dispose of the same expeditiously, preferably within nine months from today.
