Mr. Kazi, learned counsel for the petitioner submits that the present petition is filed in public interest. The poor and needy persons of this region are not getting the facility of M.R.I. and Angiography. The petitioner had given representation to respondent no.2 to make the Angiography machine functional, so also M.R.I. machine. Under Right to Information Act the petitioner received information that M.R.I. machine is not working since November 2019 and Angiography machine is not operational since 12.03.2019.

Under order dated 15.09.2020 we had asked the learned A.G.P. to take instructions in that regard.

Mr. Karlekar, learned A.G.P. submits that he has received written communication from the Dean, Government Medical College and Hospital, Aurangabad and submits that on or about 09.10.2020 the M.R.I. machine at Government Medical College and Hospital is made functional, however, because of technical problem it had stopped and within 2-3 days again it would be made functional. The M.R.I. machine at Super Specialty Hospital is functional. The installation of angiography machine has been started since 25th September 2020 and the facility of angiography will be available again in near future (approximately 3 to 4 weeks as communicated by the supplier.) 4.

The said statement is accepted, as it is made on instructions from the responsible person viz. Dean, Government Medical College and Hospital, Aurangabad.

The respondents shall make these machines operational, as it is the people from the lower income group that would be benefited, because the Government Medical College and Hospital, Aurangabad would be catering to the poor and needy persons more particularly from the lower income group. 6.

The Public Interest Litigation stands disposed of. No costs.
