Heard learned counsel for the applicant and learned APP for the State.

The applicants seek bail in Crime No.140 of 2023 registered with Dhadgaon Police Station, District-Nandurbar for the offence punishable under Sections 302, 143, 147, 148, 149 of the Indian Penal Code read with Sections 37(1)(3) and 135 of the Maharashtra Police Act.

Leave granted to correct the name of applicant No.3. Correction be made forthwith.

Perused the papers. In the First Information Report, general allegations have been made against the assailants. The applicants were acquainted with the first informant. However, after about two days she made material improvement in her statement stating the role attributed to the applicants. In the belated statement, the applicants were involved in the serious crime which may raise a doubt. The weapon allegedly used in the crime has been recovered. Nothing has to be recovered from the accused. Similarly situated co-accused based on first information report have been granted bail.

For the above reasons, the following order is passed:-
O R D E R
(I) Bail Application stands allowed.
(II) The applicants - (1) Gulabsing Khema Valvi, (2) Rahul Sima Valvi and (3) Shobha Shivaji Valvi, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each, with one solvent surety of the like amount each, in the above crime, on the condition that:- (a) The applicants shall not tamper with the prosecution witnesses.
(b) The applicants shall not contact the first informant till conclusion of the trial.
(c ) The applicants shall shall attend the trial on each and every effective date.
