PER COURT :- 1.

This is an application for suspension of sentence and grant of bail.

Learned advocate for the applicant pointed out the impugned judgment delivered by the Additional Sessions Judge, Aurangabad in Sessions Case No.19 of 2021. Learned advocate for the applicant submitted that the applicant is convicted under sections 307 of I.P.C. and sentenced to suffer R.I. for five years and to pay fine of Rs.10,000/- i/d of payment of fine to suffer R.I. for three months. The applicant is also convicted under Section 324 of I.P.C. however, as the sentence is awarded for the major offence under section 307 of I.P.C. no separate sentence is awarded for this offence. Learned advocate for the applicant submitted that the

cran2056.24 -2entire fine amount awarded by the trial court is deposited. 3.

Considering all these aspects, it would be proper to suspend the substantive part of sentence and grant bail to the applicant till decision of the appeal.

In view of the above, during pendency of criminal appeal, the substantive part of sentence awarded by the learned Additional Sessions Judge, Aurangabad, in Sessions Case No. 19 of 2021 is hereby suspended and till then the applicant be released on bail on furnishing P.R. bond of Rs.25,000/- with one surety of the like amount. The bail before the trial court.
