Present application has been filed by the original respondents for getting the delay of 32 days condoned in filing first appeal. They intends to challenge the judgment and award passed by the learned tribunal.

Learned Advocate appearing for respondent strongly opposes the application on the ground that the delay has not been properly explained.

As per the contents of the application, it is stated that the applicant had applied for the certified copies of the judgment and award

1013-ca-6603-19 (delay).docx from the concerned tribunal within the limitation and they say that it was given to the Advocate at Beed. However, those were lost/misplaced by the Advocate with whom the renovation work is going on and therefore, they were required to apply a fresh for getting certified copies. 4.

Taking into consideration these reasons, liberal approach is taken, delay stands condoned.

Civil Application stands allowed and disposed of accordingly. 6.

Registry to verify and register the first appeal and place it for further consideration on 28.11.2019.
