ORDER:

Heard Shri. Hemant U. Dhage, learned counsel for the petitioner and Shri. P. S. Patil, the learned Assistant Government Pleader for State.

The grievance of the petitioner is that, the respondents are insisting to pay the fees. The petitioner seeks benefit of EBC with retrospective effect. According to the petitioner, petitioner had submitted an application for EBC certificate, however, respondent No. 4 had endorsed that it will not be given.

According to learned Assistant Government Pleader, the petitioner had never tendered an application with respondent No. 4. In fact, the application was submitted to respondent No. 5. 4.

There are rival contentions in this regard. We need not go into the said aspect.

The petitioner shall apply afresh with respondent No. 4 in a proper format along with necessary documents. On receipt of said application, the respondent No. 4 shall take decision upon it within a period of six weeks from the date of receipt of the application with documents. In case the decision is in favour of the petitioner, then respondent-authorities shall act accordingly. 6.

With these observations, the writ petition stands disposed of. No costs.
