PER COURT :- 1.

Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0275/2024, registered at Shevgaon Police Station, Shevgaon, District Ahmednagar, for the offences punishable under sections 381, 34 of the Indian Penal Code.

This Court granted interim protection to the applicant by order dated 07/08/2024, considering the submission of the learned Counsel for the applicant that the FIR contains allegations of theft against the applicant amounting to Rs. 1,95,000/-, and to show bonafides, the applicant is willing to deposit Rs. 1,00,000/- before this Court within two days.

The learned Counsel for the applicant submits that the applicant has deposited Rs. 1,00,000/- in this Court in terms of the order dated 07/08/2024. She further submits that the applicant has attended the 1 of

948 ABA 851-2024 police station and cooperated with the investigation. 5.

Considering this aspect of the matter, the interim protection granted by order dated 07/08/2024 is confirmed. 6.

In view of the above, the application is allowed in the following terms : - i] In the event the applicant is arrested in connection with FIR No.0275/2024, registered at Shevgaon Police Station, Shevgaon, District Ahmednagar, for the offences punishable under sections 381, 34 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the police station as and when called by the police.

iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 7.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 2 of

948 ABA 851-2024 8.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 9.

The application stands disposed of.

It is directed that the amount deposited in this Court to be transmitted to the Trial Court and Trial Court to pass appropriate order on the same, at the end of trial. The amount to be kept in Fixed Deposit in Nationalised Bank till the conclusion of the trial. ( ARUN R. PEDNEKER, J. ) vj gawade/-.
