Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks bail in Crime No.50 of 2023, registered with Bamani Police Station, District Parbhani, for the offences punishable under Sections 420, 406, 418, 408, 409 read with Section 34 of the IPC and Section 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

3. Its a case of playing fraud by a man opening the financial institution without registration by showing her wife and mother as a Directors. A crime is registered against the applicant, her husband and mother-in-law. After her arrest,

49-BA.879-24.odt nothing has been recovered from her. It appears that accused/husband has played an active role. Perhaps, the present applicant might not know the acts of the husband. After a thorough investigation, without seizure of any incriminating material against her, charge sheet has been filed. After having regard to the role attributed to her, it would be inappropriate to keep her behind bar. She may be granted bail on certain conditions. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant PARVATIBAI W/O NARAYAN NAGARGJE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) She should not tamper with the prosecution witnesses.

(b) She should not assist her husband in the so called business in any mode or manner, if any.
