Heard learned counsel for the applicant. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.334/2021, registered at Sillegaon Police Station, Aurangabad for the offence punishable under Sections 392, 395, 341, 461 of the Indian Penal Code and Sections 3(1)(II), 3(2) and 3(4) of the Maharashtra Control of Organised Crimes Act.

The applicant is alleged to have purchased/ received stolen goods i.e. scrap material worth Rs.20,000/-. The same has been recovered. On investigation the charge

sheet has been filed. The applicant is behind the bars since 1/2/2002. It will take time for the trial to commence and conclude as well. In view of the same, I am inclined to grant bail to the applicant. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released in connection with Crime No.334/2021, registered at Sillegaon Police Station, Aurangabad for the offence punishable under Sections 392, 395, 341, 461 of the Indian Penal Code and Sections 3(1)(II), 3(2) and 3(4) of the Maharashtra Control of Organised Crimes Act on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence.
