Learned A.P.P. has placed on record the report received by him from the Police Inspector, Police Station, Renapur dated 19/10/2015. The same is accepted and marked as "X" for the purpose of identification. 3.

The report would show that appellant no.1Shrimant Venkatrao Jadhav and appellant no.2 - Venkatrao Krishnaji Jadhav have died. The death certificates regarding the death are also annexed to the report. Those are marked as "X-2" and "X-1", respectively, for the purpose of identification.

Learned counsel for appellant no.3 submits that the said appellant (Daulatrao S/o Venkatrao Jadhav) was convicted for the offence punishable under section 323 of the Indian Penal Code and was sentenced to suffer simple imprisonment till the rising of the Court and to pay fine of Rs.1000/-. He submits that the fine amount is already deposited and the said appellant has instructed for withdrawal of the Appeal.

In view of these facts, the Appeal abates as regards appellant nos.1 and 2 and is dismissed as withdrawn as regards appellant no.3.

Criminal Appeal is accordingly disposed of.
