I have heard the learned Advocates for the respective sides and the learned AGP. I have considered the grounds for challenge, the affidavit in reply filed on behalf of the statutory authorities and the impugned order.

I find that some communication issued by the Assistant Registrar, Co-operative Society, Pathardi would not vest jurisdiction in the A.P.M.C. Pathardi to initiate action against a Co-opted Director of such A.P.M.C. No provision is cited to indicate that a Coopted Director could be disqualified by the Secretary of the A.P.M.C. khs/MARCH 2019/7352-d

In view of the above, both these petitions, being devoid of merit, stand disposed off. Needless to state, if the petitioners have a grievance as against the co-opted Director and seek the disqualification of such a Director, it would be open to the petitioners to approach the competent forum / authority, 'if' and 'as may be' permissible in law.
