An online advertisement No.1/2023 was published by the District Selection Committee, Nanded, for Class III direct recruitment in the Zilla Parishad, Nanded. Clauses 9.12 to 9.16 are the instructions to the candidates, which read as under:- "९.
१२उमेदवारांनापरीक्षेकरीताअर्जकरतानाकोणतीहीकागदपत्रे सादरकरण्याचीआवश्यकतानाही.

१३तात्पुरत्यानिवडयादीमध्येसमावेशहोणाऱ्याउमेदवारांना कागदपत्रपडताळणीकरीतापाचारणकरणेतयेईल.
त्याबाबतचीयादीव
*2* वेळापत्रकwww.zpnanded.in यानांदेडजिल्हापरिषदेच्यासंकेतस्थळावर प्रसिध्दकरणेतयेईल.

१४कागदपत्रेपडताळणीसाठीसर्वमुळकागदपत्रेवत्याच्या प्रत्येकीदोनस्वसाक्षांकितप्रतीसहउपस्थि तराहणेआवश्यकआहे.

१५कागदपत्रपडताळणीनंतरनिवडयादीवप्रतिक्षायादी www.zpnanded.in यानांदेडजिल्हापरिषदेच्यासंकेतस्थळावरप्रसिद्ध करणेतयेईल.

१६कागदपत्रपडताळणीकरीताओळखीच्यापुराव्यासाठीस्वतःचे आधारकार्ड, निवडणूकआयोगाचेओळखपत्र, पारपत्र, पॅनकार्ड, वाहन परवाना( फक्तस्मार्टकार्डप्रकारचे) यापैकीकिमानकोणतेहीएकओळखपत्र वत्याचीएकस्वसाक्षांकितछायांकितप्रतसोबतआणणेअनिवार्यआहे." 2.
Petitioner No.1 (Avadhut) is at Sr.No.2 in the wait list and Petitioner No.2 (Santosh) is at Sr.No.1 in the wait list. Pursuant to the above instructions in the advertisement, the select list as well as the wait list was published (date is not known to the Petitioners).

Both the Petitioners received an email on 06.10.2024 at 06:33 PM, as also all other candidates from the
*3* select list and the wait list. It was communicated in Marathi to the Petitioners and all candidates that they should reach the office of the Zilla Parishad, Nanded and participate in the documents verification process commencing at 10:00 AM on 07.10.2024 in the Late Yashwantrao Chavan Hall. It was also mentioned in the email that if the candidate does not remain present and does not participate in the process, he would not be considered thereafter. In short, he would be eliminated from the said process. For clarity, the email is reproduced as under:- "
जिल्हापरिषद, नांदेडअंतर्गतकंत्राटटीग्रामसेवकपदासाठीज्या उमेदवारांनीपरीक्षादिलेलीआहेत्याउमेदवारातूनपात्रउमेदवारांनात्यांची मुळकागदपत्रतपासणीसाठीदिनांक०७.१०.
२०२४रोजजीसकाळीठीक १०.
००वाजजताजिल्हापरिषद, नांदेड(कै.
यशवंतरावचव्हाणसभागृह) येथे बोलावण्यातआलेलेआहे.
तरीआपणआपलीमुळकागदपत्रवएक छायांकीतप्रतसेल्फआटटेस्टटेडसहउपस्थि तरहावे.
आपणजज रअनुपस्थि त राहील्यासयानंतरसंधीदिलीजज ानारनाही.
याचीनोंदघ्यावी."

Barring these two Petitioners, all other 18 candidates participated in the documents verification exercise. The Petitioners claim that they were sending representations.
*4* However, they were informed in the email itself that they have to participate in the documents verification process, failing which, they would be eliminated. Now, the Petition has been filed on 05.05.2025, when the selection process has much advanced in the last eight months. The Petitioners pray that this Court should issue a Writ of Mandamus to the prospective Employer/ Zilla Parishad and direct it to induct the Petitioners by carrying out a fresh documents verification exercise for these two Petitioners and then, they be allowed to participate in the selection process. 5.
We do not find that such prayer can be entertained in the backdrop of the fact that the Petitioners were made aware that once their names are declared in the select/wait list, they have to keep their documents ready. Moreover, though they may have the documents which indicate their eligibility at the time of the filing of the forms, they were not required to tender the documents along with the forms. They were also intimated that if they do not participate in the documents verification process, they would be excluded. All other 18 candidates participated, except these two Petitioners.
