Heard the learned counsel for the applicant and the learned A.P.P. for the respondent.

The applicant seeks bail in C.R.No.0229 of 2024 registered with Kopargaon Police Station, District Ahmednagar for the offences punishable under Section 376 of the Indian Penal Code. 3.

The victim and the applicant are major. It has been alleged against him that he did sex with the victim on the promise to marry, but he did not. Admittedly, they had a love affair. The victim is able to understand the effects of the acts she was doing. The investigation is over. Nothing is to be recovered from the applicant.

Considering the facts and circumstances of the case and consensual sex, subject to allegations of cheating, the Court is of the view that further detention of the applicant would serve no purpose. Hence, the order :-

ORDER

i) The application is allowed.

ii) Applicant Abhishek Vasant Kangare be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not contact the victim till conclusion (c) He shall attend the trial on each and every date. ( S. G. MEHARE ) JUDGE rrd
