Heard the learned counsel for the applicant and the learned A.P.P. for the respondents/State.

The applicant seeks bail in C.R.No.88 of 2024 registered with Police Station Shirdi, District Ahmednagar, for the offences punishable under Sections 307, 504 and 506 of the Indian Penal Code.

The first information report reveals that the injured himself called his brother informing that the co-accused was assaulting him. The brother of the injured came on the spot and saw that the co-accused was assaulting his brother. The brother immediately took the injured to the hospital. In the first information report, the applicant was not named. However, after nine days, the injured stated before the police that the applicant was also present on the
973-BA-892-24.odt tea stall, where the co-accused assaulted him with a knife. It has been alleged against him that the knife had fallen down on the person of the deceased. The applicant gave knife to the coaccused who again stabbed him. Though, the prosecution is relying on the statement of the injured with the eyewitness standing in the queue for Darshan. It is not a case that the applicant was unknown to the injured. Considering this fact, the applicant has a good case for bail. Hence, the order :-
ORDER
i) The application is allowed.
ii) Applicant Akash s/o. Motilal Bansode be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not meet the injured or any witnesses till conclusion of the trial.
