In this petition initially dispute was raised by the petitioner that though he was qualified he was not given charge of Incharge-Headmaster. But now in view of affidavit-in-reply filed by the Government the learned Education Officer (Secondary), Zilla Parishad Ahmednagar has accepted that the petitioner does possess the qualification and also handed over the charge to him as Incharge-Headmaster being senior most Assistant Teacher possessing requisite qualification. Respondent Nos.7 and 8 accept the position as stated in the affidavit-in-reply
(2) 52wp6406.22 and they also accept that the charge is given to the petitioner. 2.
In view of this the learned advocate for the petitioner submits that the petition has become infructuous and same can be disposed off.
