Applicants are seeking suspension of sentence under Section 389 of Code of Criminal Procedure. They have challenged conviction and sentence awarded against them for offence punishable under Section 394 of the Indian Penal Code. They were on bail during the course of trial. After impugned conviction and sentence, they were taken in custody. However, amount of fine has not been deposited.

Learned counsel for the applicants submits that his clients are ready to deposit fine amount within the period of one week.

Considering the case of prosecution and quantum of sentence, I am inclined to grant suspension of sentence.

ORDER

a) Sentence awarded by the learned Additional Sessions Judge, Dhule in Sessions Case No.

79/2021 dated 07.05.2024 against applicants for offence under Section 394 of the Indian Penal Code shall stand suspended on following conditions:

(i) Applicants shall deposit fine amount within a period of one week from today.

(ii) They shall furnish P.R. Bond of Rs. 15,000/- (Rupees Fifteen Thousand Only) each with one solvent surety in the like amount.

b) Criminal application is disposed of.

c) Parties to act upon an authenticated copy of this order.
