Applicant apprehends arrest in C.R. No. 71 of 2023, registered with Usmanpura Police Station, Dist. Aurangabad, for offences punishable under sections 306, 420, 506 read with 34 of the Indian Penal Code.

FIR is lodged by Ratnaprabha Gunge alleging that her son Mahendrakumar Gunge had invested an amount of Rs. 70,00,000/- in the business of Amit Khattar. Initially, on the said invested amount profit was given by Amit Khattar. Thereafter, neither profit was given nor invested amount was returned. Amit Khattar introduced applicant with deceased Mahindrakumar. At Bhagyawant Punde

{2} 920-ABA-747-2023 that time, Mahindrakumar handed over his car to applicant on bond. Applicant demanded Rs. 10 Lakhs to deceased Mahindrakumar for returning the car. Mahindrakumar committed suicide and it is alleged that said suicide is abated by Amit Khattar, his father Jagdish Khattar and present applicant. 3.

Heard learned advocate for applicant, learned APP for respondent-State assisted by learned advocate for informant. Perused the investigation papers.

Prima facie, from the investigation papers ingredients of Section 107 of IPC are not made out. Applicant was granted interim protection and he has co-operated in the investigation and also surrendered the car as well as bond executed by deceased in his favour. The investigation is on the verge of completion. In these facts, pre-trial custodial detention of applicant is not necessary in the facts of the present case. 5.

In the result, application is allowed by confirming interim protection granted on 12th May, 2023. [NITIN B. SURYAWANSHI, J.] Bhagyawant Punde
