IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL APPLICATION NO.1874 OF 2022 IN ABA/306/2022 JYOTISING KALUSING NIMROTH AND ANOTHER

VERSUS

THE STATE OF MAHARASHTRA ...

Mr. Parikshit P. Dawalkar, Advocate for Applicants Mr. N. T. Bhagat, APP for Respondent - State ...

CORAM : NITIN B. SURYAWANSHI, J.

DATE : 28th NOVEMBER, 2022 PER COURT :

1.

Applicants are before this Court with a prayer for relaxation of condition imposed on them by this Court while granting them anticipatory bail.

2.

Applicants are accused in Crime No.46/2022, registered with Mohadi Police Station, Dhule, for offence punishable under Sections 420, 406, 408 read with 34 of the Indian Penal Code. By order dated 06/05/2022, applicants were granted anticipatory bail by this Court.

3.

Since the date of order, applicants are scrupulously following the conditions imposed on them. Learned Additional Public Prosecutor, on instructions, confirms this fact.

2 35-CrA-1874-22.odt 4.

Taking into consideration the fact that more than six months' period is lapsed since condition is imposed on applicants and the fact that FIR is lodged on 15/02/2022, but still chargesheet is not filed, application deserves to be allowed by relaxing condition imposed on applicants to remain present before Investigating Officer on every Monday and Thursday between 10:00 a.m. to 02:00 p.m.

5.

Application is, therefore, allowed in terms of prayer clause 'B'. Till filing of charge-sheet, applicants shall attend concerned police station once a month i.e. on every first Sunday between 10:00 a.m. to 12:00 noon.
