IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.5724 OF 2018 Harishchandra Namdeo Kotwade Petitioner

Versus

The State of Maharashtra & others Respondents Mr.S.V.Gundre, advocate for the petitioner.

Mr.V.S.Badakh, A.G.P. for respondents.

CORAM : R.M.BORDE & A.M.DHAVALE, JJ.

DATE : 13th June, 2018 PER COURT:

The meeting for electing of Sarpanch of Village Panchayat Turukwadi is scheduled to be held today. The petitioner is praying for granting injunction restraining respondents from conducting the meeting on the ground that though the post is reserved for OBC category, there is no elected member representing the aforesaid category. It is contended that there were two members belonging to OBC category, however, they have incurred disqualification and as such, cannot claim the post of Sarpanch. If, at all, the information furnished by the petitioner is correct, the post reserved for OBC category will not be filled in by accommodating any other candidate from different category. The apprehension expressed by the petitioner, in the instant petition, is unfounded. Apart from this, the petitioner does not have any locus to question legality of the meeting since he is not elected
