ORDER:- 1.

Heard learned Counsel for the applicant. The respondent husband, despite service, remained absent. 2.

The applicant is seeking transfer of marriage petition No. 1788/2021 filed by respondent husband for getting divorce, from the court of learned Civil Judge (Senior Division), Kalyan to learned Family Court, Dhule.

It appears that applicant is not having any independent source of income and she is also having two minor daughters to look after. Further, the distance between Kalyan and Dhule is around 300 kms. As such, it would be highly difficult for the applicant to attend the dates at Kalyan. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) Marriage Petition No. 1788/2021 is hereby transferred from the Court of Civil Judge (Senior Division), Kalyan to the Family Court, Dhule for it's disposal according to law.

(iii) The respondent is directed to appear before the learned Family Court, Dhule on or before 1st March, 2023.

(iv) The application is disposed of accordingly.
