Heard learned Counsel for applicants and learned Counsel for respondent.

Learned Counsel for applicants submits that, applicant No.2/original claimant No.2 Jitendra Sahebrao Patil is died during the pendency of appeal hence, his heirs and legal representatives be taken on record. Learned Counsel further submits that, this Court had allowed to withdraw the amount deposited by the respondents in favour of Jitrendra Sahebrao Patil. Before withdrawing the amount Jitendra Sahebrao Patil is died, therefore, his heirs and legal Pooja K.

{2} 918-CA-9379-2022 representatives permitted to withdraw the amount. 3.

Learned Counsel for respondent submits that, this Court may pass appropriate order.

Considering the submissions of both the learned Counsel and reasons mentioned in the application, application is allowed in terms of prayer clauses 'B' and 'C'. 5.
