Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.1103 of 2023 registered with M.I.D.C. Police Station, Ahmednagar, for the offences punishable under Sections 302, 397, 201 and 212 read with Section 34 of the Indian Penal Code.

The applicant has been arraigned as an accused since he was harbored the co-accused, who allegedly committed a murder. He did not participate with the main accused. There is no allegation of conspiracy against the applicant. No purpose would serve by keeping the applicant behind bar. Hence, the order :-

ORDER

i) The application is allowed.

975-BA-900-24.odt ii) Applicant Rahul Ashok Dhotre be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses.
