Mr Bolkar, learned Advocate for the petitioner submits that the impugned order is passed without notice to the petitioner and without hearing the petitioner. 2.

We have also heard Mr Aghav, learned Advocate for the respondents. 3.

No final decision has been taken on the promotion of the petitioner nor the order of promotion is set aside. It would be appropriate for the authority to hear the petitioner and pass final order with regard to the entitlement of the petitioner to the promotional post.

The authority shall take final decision with regard to the entilement of the petitioner for the promotional post viz. the post the petitioner was promoted, within a period of two months from today after hearing the petitioner and appreciating the contention of the petitioner. While passing the final order, the impugned order would not be an impediment and the same shall be passed independently. 5.

Writ Petition disposed of. No costs.
