Mr. Deshmukh, learned counsel for respondent No.1/insurance company makes a statement that, insurance company has alrady withdraw the first appeal filed by it. 2.

By way of the present application, Mr. Suryawanshi, learned counsel for the applicant, prays that the death certificate of deceased Sakaru Devla Rathod be taken on record, and further prays that applicant Nos. 1.1 to 1.3 be permitted to withdraw the amount deposited by the insurance company. 3.

In view of the withdrawal of the First Appeal by the insurance company, the civil application is allowed in terms of prayer clauses 'C' and 'D'.
