This is an application for condonation of 14 days delay in preferring application for leave to appeal. By order dated 26/10/2023, this Court issued notice to the respondents. it is submitted by learned A.P.P. for the applicant that, the respondent No.2 by name Amjad s/o Gafur Patel died on 14/10/2024. He invites our attention to the copy of Death Certificate of the said respondent No.2.

The record shows that since the name of

Cri.Appln.No.1703/2019 :: 2 ::

respondent No.1 Hasan s/o Jameer Shaikh was wrongly added as respondent though he was absconding since beginning, his name was deleted by order dated 13/9/2024. It is further seen from the record that, the respondent No.3 Shivaji s/o Mhasu Bhagwat died and the order in respect of abatement in that regard was passed on 13/9/2024. 3.

In view of the above, nothing survives for consideration in the application. The application stands disposed of. Record and proceedings, if any, be sent back to the Trial Court.
