Heard the learned counsel for the petitioner. 2.

The learned counsel for the petitioner submits that the petitioner has filed application before the trial court for impleadment in the suit as party. The said application is rejected by the trial court. The learned counsel submits that the petitioner is interested in the suit property, which is the subject matter of the suit as he is the beneficiary of the trust, so also member of the said trust.

Perusal of the order shows that earlier similar application was filed by the petitioner and the same was rejected on merits by the trial Court by order dated 6.10.2023 and thereafter, another application is filed, however, the same has also been rejected. The plaintiff is the master of his suit. The petitioner if aggrieved or has any cause against the plaintiff or defendant, the petitioner can file independent proceedings to assert his right qua the suit property.
