IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD ANTICIPATORY BAIL APPLICATION NO.759 OF 2022 WASIM SHAKIL PATHAN AND ANOTHER

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicants : Mr. N. R. Thorat h/f. Mr. Girish B. Kadlag APP for Respondent : Mr. A. A. Jagatkar ...

CORAM :

S. G. MEHARE, J.

DATE :

22-07-2022 PER COURT :- 1.

Heard the learned counsel for the applicant and the learned APP for the respondent/State.

2.

This Court has gone through the FIR. Both the accused have used the weapon and played the active role. The offence is serious. They have caused serious injuries to the injured. After considering the application, this Court expressed a view that the applicants have no case for interim bail. Thereafter, the learned counsel for the applicant started arguing at least bail to coaccused/applicant No.2 Shaharukh may be granted. He would not press the bail for accused/applicant No.1 Wasim. 3.

Learned APP has strongly opposed the application contending that the offence is serious. The weapon, stone and

914-ABA-759-22.odt knife have been used in the crime. The repeated assault has been committed by both the applicants/accused. There is also burn injury. He has referred to the injury certificate. Hence, the application may be rejected.

4.

Perused the investigation papers. The first information report is specific and points out the role played by both the applicants. The deep injury has been caused to the injured. The applicants have assaulted repeatedly with knife. The applicants appear most aggressive. The weapons are to be recovered. Considering the gravity of the offence and the recovery of the weapons, this Court is not inclined to grant the pre-arrest bail to the applicants. Hence, the application stands dismissed. ( S. G.
