Applicants seek condonation of delay of 1050 days caused in preferring first appeal.

It is submitted that for the reasons stated in the application delay needs to be condoned. There are no malafides on the part of the applicants.

The contesting party has not caused appearance to contest the application. The averments of the application are not controverted. I find no reason to infer any oblique motive in filing the appeal belatedly. The delay needs to be condoned on certain conditions.
