The petitioner has putforth prayer clause (C) as under :- "C. That this Hon'ble Court may please to pass necessary writ, order or direction in like nature and direct the Ld. Executing Court i.e. Ld. C.J.J.D. Shirur to expedite the hearing of the Spl. Darkhast bearing no. 118/2008 and Misc. Civil Application no.12/2014 and further direct the court below to dispose off the same within 3 months from the date of the order." 02.

We are of the view that a writ of mandamus should not be issued under Article 226 of the Constitution of India, to a Judicial Officer and that too in a judicial proceeding.

The petitioner, who is a decree holder, is at liberty to request the learned executing Court to expedite the hearing in the matter by giving priority.
