The applicant is an accused in Sessions Case No.218 of 2014, whose absence has resulted into execution of non bailable warrant, as ordered by learned Sessions Judge. Prayer for releasing on bail also came to be rejected, as such, present application. 2.
Perused the application. Learned Counsel for the applicant, upon instructions, undertakes that the applicant shall, henceforth, shall not seek adjournment to protract the trial. According to him, he shall also not claim any exemption but for exceptional circumstances.

In view of above, having regard to the fact that the Sessions Case is of 2014, the applicant is ordered to be released on bail on the same terms on which he was released earlier.

It is made clear that intentional default, if any, is noticed by learned Court below, learned Court below will be at liberty to proceed forthwith against the applicant for cancellation of bail. 5.
Criminal Application stands allowed, in above terms, subject to payment of costs of Rs.3500/- (Rs. Three thousand five hundred only), to be paid to Library, High Court Bar Association, Bench Aurangabad within one week from today, which shall be condition precedent for release of the applicant on bail.
