This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 65 of 2021 registered with Daithana Police Station, Dist. Parbhani for the offence punishable under Section 302, 279, 304-A read with Section 34 of the Indian Penal Code and under Section 134, 177 of the Motor Vehicle Act.

Heard. Perused First Information Report ("F.I.R.") and related police papers.

Considered the submission advanced. Similarly placed coaccused has been granted bail by this Court. The role played by the present applicant in the alleged crime is at par with the role played by co-accused. On the ground of parity, the applicant deserves grant of bail. 5.
In view of above, the application deserves to be allowed. Hence I pass the following order :-
ORDER
(I) The bail application is allowed.
(II) The applicant be released, in connection with Crime No. 65 of 2021 registered with Daithana Police Station, Dist. Parbhani for the offence punishable under Section 302, 279, 304-A read with Section 34 of the Indian Penal Code and under Section 134, 177 of the Motor Vehicle Act, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
(III) The applicant shall not tamper with the prosecution evidence.
