Learned counsel for petitioners, on instructions, submits that original proceeding i.e. Regular Civil Suit No. 156 of 2010 has already been decided by learned trial court on merits. Therefore, present petition filed against interim order passed by appellate court in Miscellaneous Civil Appeal No. 2 of 2011 become infructuous and nugatory one. He requested for suitable order. 2.
Considering the subsequent development i.e. decision of original proceedings i.e. Regular Civil Suit No. 156 of 2010 on merits, there would not be any propriety for adjudication of the present writ petition on merits. Therefore, as petition become infructuous one, stands dismissed. No order as to costs.
