We have heard Mr. Bhokarikar, the learned counsel for the petitioner. The learned counsel submits that, the respondents have issued an advertisement for filling in the post from the candidates belonging to Special Backward Class category. In fact, as per the roster the said post ought to be filled in from O.B.C. category. The petitioner belongs to O.B.C. category. The learned counsel submits that, the writ petition is filed by the petitioner bearing Writ Petition No. 6902 of 2012 against the order passed by the School Tribunal dismissing the appeal. As such, the petitioner is assailing the said roster.

According to the petitioner he was appointed as a Shikshan Sevak. The services of the petitioner were terminated. According to the petitioner he was terminated and the respondents were claiming it to be a resignation. The appeal filed before the School Tribunal is dismissed. Against the said judgment of the School Tribunal writ petition is filed bearing Writ Petition No. 6902 of 2012 and in that Civil Application No. 7204 of 2013 is filed. In the said Civil Application the learned Single Judge of this Court on 24.06.2013 has passed an order that, the appointment if any shall be subject to the outcome of the petition and the incumbent shall be informed this order. 3.

In view of the aforesaid order passed in civil application, the petitioner herein would not be concerned as to how the respondent employer is proceeding with the roster. 4.
