Applicant apprehend arrest in connection with Crime No. 146/2023 registered with New Mondha Police Station, District Parbhani for the offences punishable under Section 7 of Prevention of Corruption Act.

It is a case of the informant that the applicant herein had demanded bribe of Rs.20,000/- for mutating name of his mother in the land records on the basis of decree passed in Suit No. 76/2016. He further states that in presence of the panch witnesses the demand was verified. It is however alleged that as the applicant became suspicious, she refused to meet informant and did not receive the bribe amount. 3.
Perusal of the investigation papers shows that pursuance to 942.aba761.23.odt
the directions issued by this Court the applicant has appeared before the Investigating Officer and her voice samples is taken. 4.
Learned APP states that there is non compliance of order this Court as she was directed to appear before the Investigating Officer once in week however she did not appear during all weeks and attendance only thrice.

At this stage, this Court needs to consider as to whether custody of the applicant is necessary for further investigation if any. With the obtainment of the voice sample of the applicant, practically the investigation in the crime is over. Rest of evidence is already collected. Thus further custody of the applicant may not be necessary. Hence interim relief stands confirmed by order dated 12th May, 2023 except direction to attend police station.
