Heard learned counsel for the applicant.

The record shows that the respondent despite served with the notice of fnal disposal, remained absent. The applicant is seeking transfer of divorce petition fled by respondent husband bearing Petition No.A 63 of 2022 pending in Family Court Aurangabad to the Court of CJSD, Parbhani.

It appears that the applicant is not having any independent source of income. Moreover, she has also fled proceedings under Protection of Women from Domestic Violence Act at Selu, District Parbhani. Besides one RCC No. 81 of 2018 under Section 498-A of IPC is also going on at Selu, District Parbhani, which has been lodged at the instance of the applicant. The respondent is also attending the dates of proceeding at Selu. In the proceeding under D. V. Act judgment is also delivered. Considering all these aspects and convenience of the applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The Petition No.A-63 of 2022 pending in the Family Court, Aurangabad is transferred to the Court of Civil Judge (Senior Division), Parbhani for disposal according to law.

(iii) The respondent is directed to appear before Civil Judge (S.D.,) Parbhani on or before 19th December, 2022.

(iv) The application is disposed of accordingly.
