The grievance of the petitioner is that the respondent No.5 sought employment on the basis of fraudulent nomination of project affected person. Mr. Brahme, learned counsel submits that the petitioner has made a complaint to respondent No.3 that the project affected person certificate issued to respondent No.5 be cancelled. By order dated 03.09.2019, the respondent No.3 cancelled the PAP certificate issued to respondent No.5. He preferred an appeal. The appeal is dismissed. The commissioner also directed to initiate
917-wp-6553-20 criminal action against respondent No.5. However, no further steps are taken by the employer and the authorities against respondent No.5.

The respondent No.5 is in government service. The service dispute can be prosecuted before the Maharashtra Administrative Tribunal. However the appellate authority has already directed to initiate criminal action against respondent No.5. It is for the petitioner to prosecute his grievance with those authorities as is permissible under law.

With these observations, the writ petition stands disposed of. All contentions are kept open. No costs.
