In view of nature of dispute the learned Assistant Government Pleader was asked as to what was done by the Government. There are orders made Nagpur Bench of this Court in Writ Petition No.5228 of 2015 in which direction is given to frame scheme so that the policy is transparent and the concerned can participate in the auction process.

2 WP 5544 of 2016 2) Today, Government letter dated 14 October 2016 is produced showing that, society to which the tank is already alloted will be allowed to continue if the society is ready to deposit additional Rs.500/-. Copy of the said letter is taken on record. In view of this Government letter which the petitioner society will be bound to comply with, this Court holds that nothing survives in the proceeding. The petition is disposed of.
