A substantive revision is pending before the Divisional Commissioner at Aurangabad. The same has been lodged on 27/05/2014. This petition has been filed on 30/06/2014 . A specific statement is made in paragraph No.8 that the petitioner has not filed any other proceedings before any other Court with regard to the cause of action emerging from the order dated 30/09/2013. 2.

For this suppression of fact of the pendency of a revision petition lodged prior to the filing of this petition, this was a fit case for imposing costs on the petitioner. However, the learned Advocate for the petitioner seeks pardon on behalf of the petitioner and submits that inadvertently the said fact was not mentioned. Hence I am taking a lenient view and refraining from imposing costs. khs/MAR.2018/5532-d

This petition is, therefore, dismissed as a revision preferred by the petitioner is pending. The petitioner and respondent Nos. 4 and 5 agree to appear before respondent No.1 on 02/04/2018 at 3.00 p.m. The request is accepted and respondent No.1 need not issue formal notices to these parties.

Since the revision is preferred in 2014, respondent No.1. would endeavour to decide the said proceedings as expeditiously as possible and preferably on or before 31/12/2018.
