This is application for bringing legal representatives of deceased respondent no.3 on record. The learned Advocate Shri. Suryawanshi S.V. waives for legal representatives. He points out that intimation about demise of respondent no.3 was given to the learned advocate for the petitioner on 17.01.2024 along with details of all the legal representatives. He contends that despite this the application is filed in the month of May, 2025. He states that there is no plausible explanation for the delay.

Mr. Karpe, the learned counsel for the petitioner states in fairness that although, the intimation is received by him, the said fact is not communicated to the petitioner as a consequence of which delay has occurred.

Having regard to the settled position that clients should not suffer for the mistake of the learned advocate, delay caused in filing the application for bringing legal representatives of respondent no.3 is condoned and permission is granted to bring on record the names of legal representatives of deceased respondent no.3. Necessary amendment be carried out forthwith.

Application is allowed subject to payment of cost of Rs.5,000/- to the legal representatives.

List Writ Petition No.8443/2022 for hearing on 10th July, 2025. The parties are put to notice that the petition may be heard finally at the admission stage. Request for adjournment on behalf of the petitioner will not be considered on the next date. 6.
