IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.6789 OF 2014 Vivek s/o Vasantrao Joshi Petitioner

Versus

The State of Maharashtra & others Respondents Mrs.P.G.Sontakke, advocate holding for N.V.Gaware, advocate for the petitioner Mr.G.R.Ingole, A.G.P. for Respondent No.1.

Mr.S.S.Dande, advocate for Respondent No.3.

CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 21st January, 2015 PER COURT:

The petitioner is praying for issuance of directions to the respondents to consider his claim for allotment of plot in the industrial area developed by MIDC.

The learned Counsel appearing for the MIDC informs that the proposal in respect of development of an additional site is at formative stage and no decision in respect of allotment of area out of the proposed site has yet been taken. It is informed that 1100 applications, like that of the petitioner, were received by the Corporation and those have been rejected. Since there is no infrastructure available with the MIDC at present, it would be advisable for the petitioner to tender an application claiming allotment of plot as and when the respondents declare a policy or programme for allotment of industrial plots.

{2} wp678914.odt In view of the statement made at Bar, grievance raised by the petitioner, in the instant petition, does not deserve consideration. It would be open for the petitioner to take appropriate steps at an appropriate stage, as advised. Writ Petition stands disposed of.
